EVOLUTION OF RESPONSIBILITY: FROM IN LOCO PARENTIS TO AD MELIORA VERTAMUR.
- Authors
Bowden, Randall
- Abstract
This paper provides a perspective of the evolution of the doctrine of in loco parentis to contract law to a doctrine of responsibility of care--a sense of ad meliora vertamur (let us turn to better things). It provides a brief history of in loco parentis as it has developed in the U.S. as well as the difficulties it faces in modern academe. The paper also offers elements of what the doctrine of responsibility of care could entail to define students as student-citizens; describe academic and non-academic relationships; provide guidelines for duties of responsibility; clarify lines of responsibility; and relate student responsibilities. It is concluded that campus representatives can help curtail the damage of litigation and enhance student college experience by creating a sense of ad meliora vertamur to encompass key features of in loco parentis, contract theory and tort law; constitutional considerations, state and federal statues, and academic programs.
