- Abstract
The article deals with various legal issues related to banking regulation. It discusses who is responsible for loans when market interest rates rise or fall. It is stated that the lender does not owe "negative interest" if the reference interest rate falls below zero. It also discusses the invalidation of a model group contract for unit-linked life insurance due to unfair business practices. The Federal Court of Justice has taken a position on various legal issues in several judgments, including the interpretation of Article 4(2) of Directive 93/13/EEC on unfair terms in consumer contracts and the effective inclusion of investment conditions in an investment contract. The text provides an overview of selected legal requirements in Germany and the implementation of Basel II and European regulations.
