- Title
Retail Markets: Assessing Whether Incentivized Category Management is Compatible with Competition Laws (The Netherlands).
- Authors
Graham, Ben
- Abstract
Category management agreements between retailers and suppliers may be block exempted, and in any case are mostly not problematic. When not block exempted, possible upstream foreclosure through a category management agreement is analysed on an effect rather than object basis. If the supplier advising on category management provides financial incentives to follow its advice, a careful economic analysis of an equally efficient competitor is advised.Alternative sources provide more guidance on other aspects of category management.
