- Abstract
The present case note examines two related decisions of the arbitral tribunal in RSM Production Corporation v St Lucia. These decisions address the power of an arbitral tribunal to order security for costs and to sanction non-compliance with such order. Since the creation of the International Centre for Settlement of Investment Disputes (ICSID) in 1965, there has been no publicly reported precedent within the ICSID framework for these decisions.
