- Abstract
This article discusses the equity and fiduciary aspects of the Employee Retirement Income Security Act (ERISA). It explains that the language and history of ERISA confirm that when the U.S. Congress enacted the law it borrowed heavily from equity. It explores several questions that aim to verify whether or not ERISA has been effective in securing the welfare of employees. It says that measuring the real impact of ERISA's debt to equity on the delivery of employee benefit plans is difficult.
