Bringing Comfort to the Enemy?: The Past, Present, and Future of Habeas Corpus Petitions in Light of the Formalistic Application of Boumediene.
- Authors
Overbey, E. Carlisle
- Abstract
The article discusses habeas corpus petitions in America in the wake of the reportedly formalistic application of the U.S. Supreme Court's ruling in the case Boumediene v. Bush as of April 2013, focusing on efforts to extend the right to petition for habeas corpus to individuals other than the military detainees who are being held at the Guantanamo Bay Detention Center in Cuba. The U.S. Code of Military Justice is addressed, along with the American Constitution's Suspension Clause.
