Title
UNINSURED MOTORIST COVERAGE -- KANSAS' UNIFORM ARBITRATION ACT NOT RETROACTIVE.
Abstract
This article focuses on the court ruling on the case "Clayton v. Alliance Mutual Casualty Co.," implying that the newly enacted Uniform Arbitration Act is not retroactive and is applicable only to agreements made subsequent to its effective date. The court found that the uninsured motorists coverage in question must therefore be considered as an agreement to arbitrate a future dispute and as such was invalid.
