- Abstract
This article focuses on the court ruling given in Merrill Lynch Pierce Fenner and Smith Inc. v. Martin case. Statute of limitation under a margin account cannot be asserted in court for a stay of arbitration when party had fully participated in arbitration. He is not, however, precluded from asserting the statute of limitation in the arbitration proceeding since such defense is no bar to arbitration.
