WHEN FINAL PAYMENT TO GENERAL CONTRACTOR FOR CHURCH CONSTRUCTION WAS MADE IN 1957 AND SOME MONEY WAS RETAINED UNTIL DEFECTIVE WATER SEEPAGE CONDITION WAS CORRECTED, DEMAND FOR ARBITRATION FOR FURTHER PAYMENT MADE EIGHT YEARS LATER HAD TO BE VACATED.
- Abstract
This article focuses on the court ruling given in Thompson-Brinkworth Inc. v. St. Luke's Evangelical Lutheran Church case. When final payment to general contractor for Church construction was made in 1957 and some money was retained until defective water seepage condition was corrected, demand for arbitration for further payment made eight years later had to be vacated, since, as the court said, "the demand for arbitration was not timely made, and the statute of limitations has run against the matters sought to be arbitrated."
