BEYOND JUDICIAL ACTIVISM: WHEN THE SUPREME COURT IS NO LONGER A COURT.
- Authors
Moses, Margaret L.
- Abstract
The article presents information on the major decisions taken by the U.S. Supreme Court in the recent trials including Ashcroft v. Iqbal, Montejo v. Louisiana and Citizens United v. Federal Election Commission on the issues that were not presented by the litigants and the effect on these decisions due to changes in law. A focus is on the ignorance of traditional prudential practices and constitutional issues, exceptions clauses and the need of defining boundaries for the Supreme Court.
