- Abstract
The article presents information on the judicial elections and the rights of the litigants for fair tribunals. A focus is on the reach of the due process clauses with reference to the trial of Caperton v. A.T. Massey Coal Co. on the issue of recusal of the Supreme Court Justice. A review of the jurisprudence related to recusal in the U.S. Supreme Court is carried out. A test based on the trial of Mathews v. Eldridge is used to for assessing the violation of due process.
