- Abstract
The article examines the limitations to establishing institutional liability for historical abuse at common law in Australia. Topics discussed include the need of tortuous compensation from institutions and options for reform on the issue; applicability of aspects of civil liability legislation in Australian jurisdictions to child sexual abuse cases; and need of identifying proper defendants in cases where abuse occurred in faith-based institutions.
