- Abstract
The article focuses on lawyer's obligation to inform a tribunal of adverse authority and evaluates whether me current ethical standard is sufficient or requires modification and conjunction with the duty of competence. It mentions situations of intentional failures to raise binding authority and to reckless and careless conduct. It also mentions law society discipline decisions applying the rule and sanctions imposed as a result of breach of the duty to raise authority.
