- Abstract
The article presents information on international investment arbitration wherein a foreign investor can recover moral damages caused due to breach of international law against state party. A focus is on the bilateral investment treaty (BIT) with reference to the trial of Desert Line Project LLC v. Yemen. The history and status of punitive and moral damages in international investment arbitration and the questions based on its jurisdiction are also discussed.
