- Abstract
The article discusses the author's recommendation that the U.S. Supreme Court's ruling in the 2010 case Padilla v. Kentucky, which deals with a right to effective assistance of counsel under the Sixth Amendment to the nation's Constitution, should be applied retroactively by various state supreme courts in America. U.S. criminal immigration laws, retroactive remedies for constitutional violations under state laws in America, and the immigration consequences of criminal convictions are examined.
