The article discusses several U.S. state programs aimed at saving money be reducing prisoner populations as of April 2012, focusing on an apparent lack of properly-incentivized defense counsel members who are willing to provide habeas corpus litigation services. It states that a rational approach to the problem would include a government's willingness to provide a contingent fee system for post-conviction counsel. Several legal cases are examined, including Bailey v. United States.
