- Abstract
The article titled "Ischgl and its consequences: on the claim for warning about a corona infection" deals with the decision of the Austrian Supreme Court (OGH) regarding claims for official liability of a tourist who contracted the coronavirus during his stay in Ischgl in March 2020. The plaintiff accused the authorities of not warning him about the risk of infection and based his claims, among other things, on the constitutionally guaranteed right to life. However, the OGH ruled that there is no immediate legal obligation for administrative bodies to provide information and that such an obligation requires a simple legal basis. The right to life alone does not create a duty of action for the state authorities, according to the OGH.
