- Abstract
This article deals with the provision of abrogation, en-Nes'h, and emphasizes the importance of studying the issue of abrogating Islamic right in general, and recognizing the abrogation provision, in particular, considering that by approving or refusing abolition, or some of its forms, as well as some segments of abrogation, it also depends on taking some decisions in the Islamic legislature, as well as regarding the conclusion of the validity or annulment of certain provisions arising from some Quranic verses, as well as related specific explanations regarding some Quranic verses. Also, the importance of recognizing the provision of abrogation is directly related to the provisions of the permissible (halal) and the forbidden (haram). In this paper it is approved the attitude of the majority of Islamic law experts that abrogation is a reality, exists in the Qur'an, happened and logically is not impossible. This attitude is argued by several Quranic verses and hadiths which have suspended other prohibited provisions, and prohibited by other permitted provisions, new provisions instead of existing ones, etc. Meanwhile, it is denied the opinion of Abu Muslim Al-Esfahan that abrogation did not occur in the Qur'an, referring to authentic arguments regarding the matter in question. In this paper it is concluded that the debates about abrogation do not lie only in the sphere of the first source of Islamic Law -- the Qur'an, but these debates also pass in the field of the second source of Islamic Law -- Sunnah (Prophetic Tradition) where other legal implications are presented.
