- Abstract
Contested procedure must convey a dispute between the two parties, between one party who claims to have a subjective right to the other party and the latter having an attitude contrary to those claims. In order to initiate proceedings before the competent court, the lawsuit should be filed by the plaintiff and the defendant should be sued. The lawsuit is based on facts, and the facts are proved by means of proof. Scrutiny as evidence is a procedural action that the court directly, by means of the senses, confirms the existence or non-existence of the relevant disputed facts in a civil litigation.
