- Abstract
Inheritance law is a historical category. With the birth of classes and private property emerged the need for the existence of inheritance law. The transfer of property of the deceased to other persons - to his heirs came with the need for the existence of inheritance law rules. At this stage of development of human society, the inheritance law has emerged as an institute of civil law. Today, the inheritance law is an integral part of the legal system of a country. As part of the legal system, it deals with the study of the entire legal norms that regulate the legal inheritance relations. These relationships it mainly regulates through positive legal norms. There is no doubt that the inheritance law is a scientific discipline. As a scientific discipline, the inheritance right includes all legal opinions of scientists who refer to aspects of legal regulations of legal inheritance relations, commenting the legal norms, systematizing, interpreting, explaining and criticizing their legal uncertainties and deficiencies.
