- Abstract
This article discusses the court decision regarding a case where a passenger in an insured vehicle was injured and sought to avoid arbitration by contending that she had not agreed to arbitrate. The court compelled arbitration on the basis of strong public policy favoring arbitration as indicated by the adoption of the Uniform Arbitration Act and the compulsory arbitration statute. In addition to this strong policy the court also cited the passenger status as a third-party beneficiary to the insurance contract.
