- Title
Recovery of Cable Repair Ship Cost Damages from Third Parties That Injure Submarine Cables.
- Authors
Burnett, Douglas R.
- Abstract
The article focuses on the legal aspects of the full cost damages recovery of a cable ship for the repair of an injured submarine cable. It states that standing and running charges for cost damages are rooted on the development of cable maintenance agreements, wherein a regional contractual consortium of cable owners employ one or more cable ships to dedicate to repair of cable systems owned by the parties in the agreement. It mentions that cable maintenance agreements include conditions that allow cable ships to be subchartered to third-party cable owners. It adds that the international law supports the recovery of the full cost of the cable ship used in the repair of an international cable. Moreover, the cost of repair includes the use of the cable ship during the repair period.
