- Abstract
The article offers information on exigent circumstances and searches incident to arrest in the state of New York. It reflects on the decision by the U.S. Supreme Court in United States v. Robinson and discusses the relationship between the cases People v. Smith and People v. Gokey. The application of the Gokey rationale by courts in handling such cases is discussed, as well as suggestions for the U.S. Court of Appeals on how to eliminate the rationale's inconsistency.
