- Abstract
The article discusses the Burkean perspective on patent eligibility and the arguments on the traditional limitations on patentable subject matter embodied with technological arts, mental steps and physical transformation doctrines in the U.S. The combination of useful, concrete and tangible result criterion with technological arts, mental steps, and physical transformation doctrines is a good step to strengthen the positive returns to human but modernization of these concepts is a wiser way.
