- Abstract
The retirement compensation arrangement (RCA) provisions were first introduced in 1986 as an anti-avoidance mechanism relating to various tax-deferral strategies. They have since become an important tool in employee pension planning. The authors provide a historical perspective, an overview of the pension-planning and income tax considerations, and several scenarios illustrating the application and utility of RCAs. The authors conclude with an overview of the new penalty provisions and advantage tax rules enacted in 2012 in response to certain strategies adopted by private companies that the Department of Finance felt unduly exploited the RCA tax regime.
