- Abstract
The article presents a critique on the essay by Joel Feinberg, titled "A Child's Right to an Open Future," published in his book "Freedom and Fulfillment, Philosophical Essays." The author disagrees with Feinberg's support of the court decision in Wisconsin v. Yoder, which allows Amish parents to remove their children from conventional schooling after finishing eighth grade. He argues in favor of a child having rights to develop (CRD) and against the child's right to an open future (CROF); a child's right to enlightenment takes precedence over parental rights to stunt growth and development in their offspring. Reference is made to the distinction made by D. N. MacCormik between a will-based view of rights and an interest-based view of rights.
