- Abstract
The article discusses displacement and preemption aspects of the U.S. Oil Pollution Act of 1990 (OPA) effect on general maritime law and state tort law punitive damages claims. It discussed many cases which has a lasting effect on the issue. Topics discussed include punitive damages under general maritime law, the OPA and maritime law punitive damages, and displacement of pre-existing maritime claims.
