- Abstract
The Iraqi constitution issued in 2005 adopted the principle of separation of powers, and relied on the parliamentary system as a basis for governance, and this system has characteristics, including the duality of the executive authority represented by the President of the Republic and the Prime Minister, who is responsible for his ministry before Parliament, in addition to the need for cooperation and balance between the authorities, In order to reduce tyranny and prevent the domination of any authority over another, as well as protect rights and freedoms, and there is no balance that cannot be achieved by merely pronouncing it, but rather it must be organized by special legislation, and that the constitution has favored the legislative authority over the executive authority.
