- Abstract
The article focuses on the reforms in the Italian Bankruptcy Law (IBL) which provide major deviation from rules of the corporate law. It mentions that the corporate capital which is the core of the Italian Corporate law has various functions including a general guarantee for the creditors, a fixed investment and a system to inform the creditors about the wealth of the company. It states that the Section 182-sexiesof the IBL reflects on the duty of the directors during corporate restructuring.
