- Abstract
The article discusses the U.S. Congressional debates that lead to the passage of the Detainee Treatment Act of 2005 (DTA). It explores how the law and lawyers have been transformed into enemy combatants. It states that like Osama bin Laden's prophesy of a global conflict, Americans have a "near enemy" where the rule of law, liberty and democracy are threatened by proliferation of the jaundiced view of the law and its sympathizers. Americans also have a "far enemy" which the author suggests as al-Qaida and its impersonators.
