The article reflects on the first inventory of the essentials of marriage that preclude enforceable agreement to form and govern marriages. It considers those essentials protested by the individuals as unjust constraints on their prerogatives. It further comments on the U.S. Defense of Marriage Act (DOMA) and considers it as a bolster of essentials of marriage.
