DEVIL TAKE THE HINDMOST: REFORM CONSIDERATIONS FOR STATES WITH A CONSTITUTIONAL RIGHT TO BAIL.
- Authors
Gross, Jordan
- Abstract
The article explores the reform of the bail system in the U.S. with the introduction of laws such as the Bail Reform Act in 1984. It explores the origins and history of English and American bail law and the role and regulation of commercial bail bonding in the U.S. Some of the legal and practical barriers to reform unique to right-to-bail states are discussed, including jurisdictions without the concentration and scale of resources to maintain pretrial services programs.
