- Abstract
The article explores the available provisions in common and legislative laws that could be used for prosecuting human trafficking for sexual exploitation in South Africa. It mentions the proposed legislation the law-making body in the country to address the trafficking. However, it explains that drafters of legislation would face difficulty of what constitute the offence of trafficking including elements. In this regard, drafters visits the provisions of the Constitution that provides specific protection of rights of children.
