- Abstract
The focus of this article is on trading documents and, especially, the applicability of warehouse receipts and common Austrian financing devices. The article outlines the Austrian principles for transferring goods to achieve ownership and grant security rights (in particular, pledges). Moreover, the general rules and concept of warehouses and warehouse receipts will be discussed as well as other Austrian trading documents. This article also examines the disputed Austrian doctrine and legal basis for creating warehouse receipts issued to order. However, as these instruments are not commonly used to transfer goods in Austria, the applicability of international trading documents will be addressed as well. Although warehouse receipt financing has great importance for many countries, in Austria, the warehouse receipt issued to order has no practical relevance. In practice, creditors in Austria will often refer to other, often more elaborate, means to transfer security rights.
