- Abstract
This Comment explores captive insurance companies and the potential for abuse within the policies they draft. Various states throughout the United States are promoting the formation of captives within its borders, but few states recognize the need to protect subsidiaries insured by captives from possible abuse. This Comment discusses the alleged sexual abuse USA Swimming is facing and the policies written by the organization's captive, The United States Sports Insurance Company, during those years of alleged abuse. USA Swimming and its alleged abuse provide an illustration of the potential for abuse captives are provided when writing policies. This Comment concludes by discussing state captive regulation currently in the United States, while providing suggestions for regulations in the future.
