- Title
Right and Responsibility in Fourth Amendment Jurisprudence: The Problem with Pretext.
- Authors
Citron, Eric F.
- Abstract
The article focuses on the right and responsibility under the U.S. Fourth Amendment Jurisprudence. It has been stressed that the Amendment's analysis failed to appreciate the wrongfulness of pretextual police behavior, particularly in searches and seizures. This could be attribute to individual's right to privacy and insufficient emphasis on responsible police behavior. The investigatory power of the state is entrusted by the police for people.
