- Abstract
The article discusses the results of a detailed empirical study on Canadian malpractice experience and compares malpractice trend in Canada with trends in the U.S., Great Britain and Australia as well as the malpractice liability experience of physicians in Canada with the malpractice experience of dentists, engineer and lawyers. It analyzes changes associated with rising trends in frequency and severity of malpractice claims namely changes in professional environment, social environment and legal environment. Several data sets that were not analyzed for these purposes in Canada were assembled for the study. It concludes that advanced medical technology and practice can contribute to improved aggregate patient outcomes as well as increased malpractice liability.
