- Abstract
The article discusses the inadequacies of existing forms of compensation for occupational diseases in the U.S. There are two possible sources of compensation for employees who acquired an occupational disease such as state law tort lawsuits against third-party manufacturers and suppliers and claims under state workers' compensation laws. The revision of some of the policies governing tort litigation and a federalized system of compensation for certain occupational diseases are the two reform proposals to the U.S. Occupational Safety & Health Administration (OSHA).
