- Abstract
The author shares his views on the problem of discretionary justice in the U.S. and explores the concept of decision-making in terms of decisional referents. He considers the significance of internal constraints on the exercise of discretionary power, noting that some types of internal constraints are not visible to observers. He offers a comparison of judicial and administrative referents. He examines the implications of a decisional-referent conceptualization of official decision-making on openness and substantive rationality. He analyzes some of the developments in administrative standing in light of the conceptual structure described.
