- Abstract
The purpose of this paper is to show how the Mexican constitutional justice has dealt with the topic of unconstitutionality due to legislative omission, given the absence in the Political Constitution of the United Mexican States (CPEUM) of a means of constitutional control expressly provided to activate the legislator when he has been disregarding his duty to legislate on a constitutional mandate. The foregoing with the purpose of demonstrating that, despite the interpretative efforts of constitutional justice in Mexico, there is a need for a specific regulation regarding unconstitutionality due to legislative omission. Therefore, the analysis and development of this text will be done under the case study method and the corresponding analysis and interpretation of the constitutional and legal framework that regulates the control of constitutionality in Mexico (legal and exegetical dogmatic methods), as well as the comparative method in order to highlight how the subject under study has been regulated in other countries.
