- Abstract
In this article, it was valideted the possibility of abstract control of the public budget constitutionality in Brazil by analyzing the evolution of the positions registered by the Federal Supreme Court jurisprudence over the last 20 years. It was applied, in the methodology, a descriptive study with quali-quantitative approach through bibliographical and documentary research. It was examined the legality of judicial control of budgetary laws and administrative acts regulated by them, as well as their legal nature. It was concluded that judicial control of the budget laws and of the public administration acts regulated by them is possible and that this is the current understanding adopted by the Supreme Court.
