- Abstract
Mining affects the development levels of countries, especially industry. Many products we use today originate from processing minerals obtained from mining activities. Mining Law, which is acknowledged in order to carry out mining activities on a legal basis, contributes to providing sustainable development, protecting the environment and public health and solving incompatibilities that may occur. It is tried to provide the functionality of mining policies with the rights regulated in mining Law and administrative sanctions applied in case of breach of an obligation. In mining, some sanctions determined by the lawmaker are imposed on those who carry out illegitimate activities to continue productive activities, provide using public resources effectively and productively and ensure functioning appropriately to the environment and human health. This study is about administrative sanctions applied to people who carry out activities against mining legislation. Administrative fines that are in the law no. 3213 are explained in the light of the judgements of Administrative Court, District Administrative Court and State Council; and recourse to the court, application period, place, type, procedure and principles are included. The declaration, obtaining, and time out matters of final administrative fines are examined. Mining administrative fines are evaluated within the Mining Law, Turkish Criminal Law, Misdemeanor Law, Code of Criminal Procedure and international legislation.
