- Abstract
The article focuses on characteristics of federal and state caseloads and contribute to inefficiency and unfairness and variations in state substantive laws and use of innovative procedures to address particular segments of a caseload. It mentions proportionality in federal court, first by recognizing the unique history of Rule 26 of Federal rules of civil procedure. It also mentions characteristics of state civil caseloads and prevalence of counsel.
