- Abstract
The article focuses on research that have examined the relationship between the strength of a plaintiff's malpractice claim and the eventual settlement of her case. It says that a search for patterns and policy implications was proven by the resulting body of data. It also states that the studies divided the claims into three or more categories such as negligent, not negligent and uncertain. As a conclusion, it claims that medical malpractice settlements are neither random nor irrational.
