- Abstract
The article presents the resolution of the legal case of the state of Maine vs. Stephen L. Johnson. In the case, the Court of Appeals affirmed the Environmental Protection Agency's (EPA) approval of the state of Maine's discharge permitting program for non Indian sites, but held that the EPA had erred in exempting tribal-owned facilities owned by the Penobscot and Passamaquoddy Indians.
