Dam Owner Responsible for Maintenance and Repair of Dam on Public Lake.
- Abstract
The article reports on the ruling of the Indiana Court of Appeals that the state does not own the land underneath a dam built on a public freshwater lake and therefore is not responsible for the maintenance and repair of the dam. Ten acres of Indiana's Lake George had been given to the nonprofit Lake George Cottagers Association (LGCA) for preservation. When a dam was built on the LGCA section of the lake, the LGCA claimed that the state should maintain the dam.The court noted other statutory provisions granting Indiana's Department of Natural Resources (DNR) the authority to oversee dam repair.
