- Abstract
The article explores the extent to which the constitutional right to informational privacy in the U.S. protects medical records from improper acquisition or dissemination by state agents. Topics covered include a background on the Supreme Court case Whalen v. Roe which is believed to have established the right to informational privacy, the variations across the circuit courts as to what information is protected by the right, and an argument for an amendment to the Privacy Act.
