Subrogation Waivers.
- Authors
Palley, Stephen D.; Lewis, Arlan D.
- Abstract
The article offers information on subrogation waivers, where insurance companies use subrogation to handle their insured and file suit, to recover money that the insurance company has paid to the insured after a loss. It states that in some U.S. states, the subrogation rights are waived by agreeing to provide builders risk insurance in a construction contract. It mentions that some courts have refused to enforce a subrogation waiver for the benefit of subcontractors.
