- Abstract
In this essay I examine the institution of the head of state in Romanian constitutional history, by focusing on the relation between the constitutional design of this institution and its functioning within situations of crisis. Drawing on the paradigm of the state of exception as developed by Italian philosopher Giorgio Agamben, I aim to situate the head of state in Romanian constitutional history in a wider intellectual, jurisprudential and political history of authoritarian practices that are specific to modernity. In this way, I shall explore the dictatorial regimes in Romanian history from 1938 until 1989, by focusing on their relation to situation of crisis and by analysing the specific suspension of the legal form that they brought about.
