- Title
Waiting for the Other Shoe: Hudson and the Precarious State of Mapp.
- Authors
Moran, David A.
- Abstract
The author focuses on the U.S. Supreme Court case Hudson versus Michigan. He states that the case comes to be seen as a historic case leading to changes in law. He notes that the courts had applied the case to deny exclusionary relief to victims of knock-and-announce violations. He examines three decisions from the federal courts of appeals and uses them to show that anti-exclusionary judges in the lower courts are not waiting for the Supreme Court to explain Hudson.
